Your concerns are well founded, and I would urge to bring the following to the attention of the www.ilovefreegle.org and Freecycle membership.<br />

In order to protect the public’s health, the sale or supply of any medicinal product in the UK is strictly regulated under the Human Medicines Regulations 2012.<br />
<br />
To summarise; <br />
<br />
- The sale or supply of a prescription only medicine (POM) other than by a registered pharmacist on receipt of a prescription issued by a qualified heath practitioner, is a criminal offence<br />
<br />
- The sale or supply of a pharmacy only medicine (P) other than by a registered pharmacist, is a criminal offence.<br />
<br />
- The sale or supply of general sales ledger (GSL) ledger medicine (the sort you would normally find on sale in a non-pharmacy retail outlet) other than from a lockable premises, is in the MHRA’s view, a criminal offence.<br />
<br />
The supply of any medicinal product outside the regulated supply chain, poses a serious risk to the public’s health.<br />
<br />
Medicines of any kind should not be supplied to the public, other than in the circumstances I have described above.<br />
<br />
The MHRA will seek to prosecute those who sell medicinal products outside the regulated supply chain.<br />

No money is exchanged, there is no selling involved, it is purely an act of kindness from one member of a community to another, which also has the added bonus of keeping usable items out of landfill. We have had a look at eBay's rules on medicines at http://sellercentre.ebay.co.uk/medicine-and-healthcare-products-policy and would like to know if Freegle groups had a set of rules equivalent to those, would that be legal?<br />
<br />
We are aware of the facility for local pharmacies to take in unwanted medicines and then dispose of them, but we are keen to encourage waste prevention in the community. The government policy https://www.gov.uk/government/publications/waste-prevention-programme-for-england has recently been introduced. It is a framework for all organisations to rethink their policy, guidelines and actions so that less stuff enters the waste stream. If it is illegal at present for a private individual to pass on an unwanted GSL item to someone else, then we hope the MHRA will take active steps to set up a safe and legal system for medications (or the packaging) to be recycled or reused instead of being disposed of as waste, or to give people no other choice than to throw them in the bin to end up in landfill.<br />

UPDATE JUNE 2015: EU Directive 2011/62/EU amending Directive 2001/83/EC has now put a stop to any medicines being donated, as it has been implemented to ensure there is no break in the licensed audit trial from manufacturer to end user. <br />

POM-VPS – these are prescription only medicines and may only be supplied by a veterinary surgeon, pharmacist or suitably qualified person (SQP) in accordance with a prescription from one of these persons.<br />

NFA-VPS – these are medicines that may only be supplied by a veterinary surgeon, pharmacist of SQP<br />
<br />
Medicines carrying any of the above distribution categories cannot be offered via Freegle.<br />

There is another distribution category called AVM-GSL. There are no legal restrictions in the Veterinary Medicines Regulations for the retail supply of veterinary medicines classified as AVM-GSL (“over the counter” medicine) but a responsible approach to the supply of these medicines is still expected. Medicines carrying this distribution category could be offered via Freegle.<br />

Those with active access to the Mailbox will...<br />
<br />
1. Ensure prompt and regular mailbox cover:<br />
Answer or forward all new issues coming into the Mailbox within 24 hours<br />
Coordinate time off to ensure the inbox can be checked at least every 24 hours; notify Reps in advance if this is not possible<br />
Follow up outstanding or unresolved enquiries in a timely manner<br />
<br />
2. Act with integrity:<br />
Respond objectively and in a professional manner to all enquiries<br />
Not speak in a negative manner about other networks<br />
Inform enquirers of their nearest free reuse groups, or how to find them, where appropriate, regardless of the network<br />
<br />
3. Seek advice where necessary:<br />
Be mindful that emails sent are on behalf of Freegle and ask the advice of the Reps if unsure of the appropriate response<br />
<br />
4. Maintain an organised mailbox:<br />
Archive all messages once resolved or passed on<br />
Label messages meaningfully<br />
Be prepared to provide figures on the types of enquiries to Central, for the purpose of transparency<br />
Delete spam only, nothing else<br />

5. Promote group autonomy:<br />
Forward as much as possible directly to the group owner address in question, or an organisational Freegle Team where appropriate, informing the enquirer that this is being done. For complaints and sensitive issues, see below<br />

6. Maintain confidentiality:<br />
Not divulge the Mailbox password to anyone except those authorised by the Reps to have access to the Mailbox<br />
Change the Mailbox password when an authorised person or member of the mailbox team steps down and ensure the following are notified of the new password:<br />
All active members of the Mailbox Team (currently Jacky Barratt & Susan Anderson)<br />
All back up members of the Mailbox Team (currently David Easby)<br />
One member of the Reps/Tech Team (currently Paul Thompson)<br />
For complaints and sensitive issues:<br />
Be mindful of sensitive issues when forwarding or copying others on emails<br />
Give the local group the chance to deal fully with any complaints, but seek permission from the person complaining before their email is shared with the moderating team. <br />
Ensure that a complaint is not dealt with by a member of the Mailbox team who is also a moderator for the group concerned<br />
Respect the confidentiality of emails and the need to share them only within the relevant and necessary Freegle teams<br />
Where permission is not given, file away the complaint unless the complaint is about items or actions not being Free or Legal. In this case, the Reps will be informed for their consideration.**<br />
If the complaint is about one of the groups of a member of these teams, send it to one other person from the relevant team instead<br />

We have occasional problems with people not showing up to collect<br />
items, or changing their minds. If you're getting stuff for free,<br />
it's only fair to be polite and thoughtful about the pickup<br />
arrangements - as most of us are. So please make sure you are<br />
absolutely going to show up when you say you will.<br />

If you're not sure if you can or will show, then let someone else<br />
take the offer. Remember, people talk... and if you become known as<br />
a "no show", then members will pass you by for someone else. Sure,<br />
sometimes last minute emergencies pop up; life happens... but if you<br />
can't turn up, it's courtesy to let them know. If you were staying<br />
in for someone, you'd want them to let you know if they couldn't<br />
come, right?<br />

When you post an OFFER, you can choose who gets it however you like.<br />
There are always going to be no-shows - but you can reduce the<br />
chances of it happening to you by choosing people carefully.<br />
<br />
First-come-first-served is often not the right choice. Some people<br />
pounce on items and send a quick "I'll take it" just to get dibs,<br />
without really thinking about whether they actually want it. If they<br />
change their minds, they might just not show up. So if you pick the<br />
first response, you're more likely to have trouble. Plus it doesn't<br />
give people who don't sit in front of a computer all day a chance,<br />
and you might get a later reply which makes you wish you'd not<br />
decided already.<br />
<br />
Instead, use the Fair Offer Policy and take some time out and<br />
evaluate your responses for at least a few hours, if not for a whole<br />
day. If someone takes the time to reply politely and explain why<br />
they want an item, they're much more likely to show up, or at least<br />
let you know if they can't.<br />
<br />
After you have picked someone, let them know, but hold off on sending<br />
your address until they respond again. If they take the trouble of<br />
sending you emails back and forth, they are very unlikely to stand<br />
you up. Once you've told someone they can have an item, please don't<br />
just change your mind and give it to someone else, unless<br />
arrangements fall through; if you do change your mind, please let<br />
them know.<br />

Remember that not all no shows are deliberate. People get lost, have<br />
car troubles, run late from meetings, or have one of many other<br />

Have you ever wondered how you could persuade members who are offering<br />
stuff to hold back a little before making their decision? Do you get<br />
daily digests littered with 'Offer' then 'Taken' before you even knew?<br />
That's what the fair offer policy is all about.<br />
<br />
Any member who subscribes to the fair offer policy agrees to wait a<br />
reasonable time before making a decision as to the recipient of their<br />
offer. A reasonable time would normally mean around 24 hours. That<br />
gives those with limited Internet access, and those who only receive<br />
digests, a fair chance to respond, but is not so long that the 3-day<br />
rule for cross posting is compromised.<br />
<br />
Amongst other things, that will mean that the first person to respond<br />
does NOT automatically get the item. Experience across Freegle<br />
groups shows that it's rarely those who reply rapidly who are the most<br />
deserving recipients (and there's an increased chance of no-shows).<br />
If in doubt, look at the respondents posting history by using the<br />
search function in 'Messages'. Even that doesn't always give an<br />
accurate picture, as some members rarely offer, but frequently respond<br />
to wanted posts. A better guide would be based on what sort of items<br />
are requested or offered. Ultimately, it's your property that you're<br />
gifting. It's entirely your choice, and no-one (including yourself!)<br />
has the right to make you feel guilty over your choice.<br />

We know that a lot of you like to use the group in a fair way, and you<br />
do so by offering your item to the first person to reply to you. This<br />
is far from being the fairest way, and here are some reasons why:<br />
<br />
1) We don't vet members, they can be anyone. Maybe traders sitting by<br />
the pc all day, waiting for the next post of something they know they<br />
can make some money out of when they sell it. They have an email<br />
already written, they just have to paste and send.<br />
<br />
(They won't always tell you they intend to sell, which is against our<br />
rules - people MUST declare ANY intention to sell items up front - if<br />
you're worried, ASK them. If you find someone sells your stuff<br />
without having declared it to you, get in touch with the moderators<br />
right away.)<br />
<br />
2) Some people are so enamoured with the idea of getting things for<br />
free they sit waiting by the pc and respond without thinking too<br />
carefully whether they really want or need the item you're offering.<br />
These people are most likely to not show up to collect as they'll get<br />
to the time and realise they don't really want it after all.<br />
<br />
3) There are a lot of deserving people on the group who can't always<br />
get to a pc to see the messages right away, but who need the item more<br />
than the first person to respond. Some people are in a situation<br />
where they only have access at the library or a friends house. By<br />
picking the first person to respond you're excluding these people from<br />
even having the chance at an item, as often you've sent in the Taken<br />
message before they see the Offer.<br />
<br />
You're entitled to ask reasonable questions to satisfy yourself that<br />
the person you've picked is telling the truth. You're giving away<br />
your items and you have a right to choose who they go to and whether<br />
they are used by that person or if you're happy for them to take to<br />
sell on.<br />
<br />
The best way to choose a recipient is to wait 24 hours, (known as the<br />
"Fair Offer Policy") read all the replies, then choose one any other<br />
way. You could say anyone who has a 'z' in their email<br />

There's been a bit of publicity this weekend and with the sudden influx <br />

to have a little word in your ear about message delivery settings <br />
(it's a fascinating subject)<br />

When you join a yahoo group the default setting is individual messages<br />
(which in this group means that you will be getting anything from just a few to<br />
a hundred or more emails a day)<br />

If you can't cope with this number of emails daily then there are<br />
other options:<br />

You can change your settings to DAILY DIGEST this is when all the<br />
posts to the group are bundled together in one email that gets sent<br />
out daily.<br />
<br />
If this is still too many you can choose SPECIAL NOTICES This is the<br />
logical option for members that want to give stuff away but aren't<br />
really interested in reading what every one else has got to say, or<br />
who have a yahoo account and are happy to just pop in and look at the<br />
messages on the website.<br />

Every now and then an unmoderated member posts a message which is against the Membership Guidelines of $groupname. It's usually an honest mistake because the member just didn't realise it was against the rules.<br />

When a member who is not moderated posts something, it immediately goes out to all the members who receive individual emails. All the mods can do at that point is to delete the message from the group site, and put the poster on moderation to prevent future errors by that member.<br />
<br />
We don't want to moderate the whole list, because the problems are really pretty rare, and there's no sense in slowing down everyone's messages to prevent those few from slipping through.<br />
<br />
So, if you receive a message that is outside of the groups mission (pet ads for breeders, for sale/trade, seeking jobs, personals, or anything illegal or adult), you might want to check the group site to see if the message has been deleted. If it has, then you will know that the moderators have it under control. If it's still there, please forward the message to the moderators at: $owneremail.<br />

Below is a selection of admins that have been pillaged (with permission) from various Freegle groups that all basically contain the same message. You are welcome to use them in their entirety or otherwise.<br />

= Be Nice =<br />
<br />
We've found that the vast majority of members are very nice folk, who are<br />
naturally courteous and polite, so this probably won't apply to most of you, as<br />
you'll do it anyway, thank you (but please read it anyway). However, there are<br />
a minority of members who don't seem to have grasped the message that you get a<br />
much better reaction from other members if you're nice to them.<br />
<br />
For those to whom being nice doesn't come naturally, here are some guidelines:<br />
<br />
1) Don't demand, beg, or exaggerate the situation in your posts or replies.<br />
Keep it simple, polite and factual.<br />
<br />
2) Reply ONCE to posts. Many items are very popular, and it's totally<br />
unreasonable to expect personal replies to every message, especially if the<br />
original post was an offer. This isn't the offerer being rude, but practical.<br />
If you've had 20-30 replies, it just takes too much time to send individual<br />
emails. It's actually a group recommendation that the taken message be used to<br />
thank all those who responded, rather than attempt individual emails.<br />
<br />
3) Communicate effectively. If you're collecting or delivering, make sure that<br />
you have enough information to actually find the address. Make sure that you<br />
can contact the other person if some problem arises - there's nothing more<br />
frustrating than a 'no-show'. A call to say you'll be a bit late or would like<br />
to rearrange is the minimum courtesy you should be extending.<br />
<br />
4) Don't ask for something on the off chance you might get it. If you can use<br />
it, good, but one of the annoyances of Freegle is members asking needlessly<br />
for items they don't really want (as they often change their minds, and, rudely,<br />
then don't collect).<br />
<br />
5) Use the fair offer policy. This gives members with limited web access time<br />
to reply. It's sad when somebody with a real need doesn't even see an offer<br />
before it's been taken, precisely because they don't have the same access to the<br />
web as more fortunate members.<br />
<br />
6) Most of all (and it shouldn't need to be said) don't be rude, abusive,<br />
annoying or demanding towards other members. Anything which would be considered<br />
flaming in a discussion forum is definitely out, and should be reported to the<br />
moderators at the owner address.<br />

The question whether or not to allow pets and other animals to be offered on Freegle is a controversial one and the source of much strife. It is also a decision that is up to local groups to decide.<br />

‘Other animals’ include live animal feed (e.g. mice or locusts to be fed to reptiles) and livestock (e.g. poultry)<br />
<br />
When deciding whether or not to allow pet and animal posts the moderator team may want to consider what local facilities are already available for re-homing pets, such as rescue centres, whether the group is an urban one or a rural one, and whether the moderator team have the time and experience to give to this. They may also wish to run a poll on the group - if you have polled your members, that can be helpful when dealing with complaints. Be aware that there have been instances of news of such a poll might reach organisations who have very strong opinions on the subject, and they may encourage people to join your group with the single purpose of voting on the poll. You may want to consider suspending new applications for the duration of the poll.<br />

Some groups do not allow animal posts of any description, some allow offers but not wanteds. Some allow posts for animals that local centres do not cater for, such as fish.<br />

<div>The question whether or not to allow pets and other animals to be offered on Freegle is a controversial one and the source of much strife. It is also a decision that is up to local groups to decide.<br />

‘Other animals’ include live animal feed (e.g. mice or locusts to be fed to reptiles) and livestock (e.g. poultry)<br />

When deciding whether or not to allow pet and animal posts the moderator team may want to consider what local facilities are already available for re-homing pets, such as rescue centres, whether the group is an urban one or a rural one, and whether the moderator team have the time and experience to give to this. They may also wish to run a poll on the group - if you have polled your members, that can be helpful when dealing with complaints. Be aware that there have been instances of news of such a poll might reach organisations who have very strong opinions on the subject, and they may encourage people to join your group with the single purpose of voting on the poll. You may want to consider suspending new applications for the duration of the poll.<br />

Some groups do not allow animal posts of any description, some allow offers but not wanteds. Some allow posts for animals that local centres do not cater for, such as fish.<br />
