The decision as to whether food should be allowed is one for the local moderating team to make. It does meet the requirements of being free, legal and appropriate for all ages, but some moderators feel that open foods are too dangerous; opened containers could also have become spoiled, or inadvertently contaminated with other ingredients such as nuts (which some people can be very allergic to). The group should decide its own policy here. Good things to consider are whether the food is sealed, and whether it is in date - noting the difference between USE BY DATE which it's definitely not okay to exceed and BEST BEFORE DATE which is more of a recommendation and doesn't indicate that the food isn't fit for human consumption.

Whether food has been illegally imported could also be an issue you might wish to consider, here is a very comprehensive guide where you can do this:

http://foodimports.direct.gov.uk/index.html

It's also worth bearing in mind that food isn't always used for human consumption:

*Food and its packaging can have other uses such as arts and crafts.

*People use baby formula as a fish or rat food.

*Colas can be used for removing lime scale and in a number of science projects.

*Any organic matter can be used for composting.
Carolinehttps://wiki.ilovefreegle.org/index.php?title=Problem_members&diff=1488Problem members2010-05-26T16:40:45Z
Caroline:

Usually the best way to deal with problem members is politely and diplomatically. This is for the following reasons:

* As a moderator, you can be perceived as being in a position of authority and some people may resent you for that or possibly make assumptions about you.

* Problem members won't necessarily go away even if you do ban them, so it is better to maintain the moral high ground.

* There are always two sides to every story, and sometimes members when appear to be difficult they can actually be just a bit confused.

How to handle awkward members in a non-confrontational manner:
*Try to work with them - ask for (and listen to) their side of the story before making any assumptions.

*Give them the benefit of the doubt (even if it seems highly unlikely)

*Always be civil.

*Ask all concerned parties to forward all relevant emails to you.

*Acknowledge their contribution to the group (if they've actually made one that is!).

*If the complaint is of a criminal nature don't try to solve it yourself, suggest that the complainant contacts the police and tell them that you are happy to be contacted (assuming you are).

*If you're threatened with legal action, try not to worry too much these are almost always empty threats. You can send them this if you like.

*Dont take the member off moderation until the issues are resolved (if at all).

*If you find a member particularly difficult, ask a co-mod to take over. This takes stress off you, and it also shows the member that it's not just some personal vendetta on your part, because someone else agrees with you.

However, while you are doing this it is best not to:
* Allow their behavior to adversely affect the other members of the group.

* Let the member break any rules

* Tolerate personal attacks or insults of any kind whether directed at mods or members.

* Feel bad or take it personally, it happens to other people too:

http://www.urban75.com/Mag/troll.html

When you've finished investigating, you can just state your position and then drop it - avoid letting them draw you into repetitive or circular arguments. You probably have better things to do with your time! If a member is getting to you do seek support from your fellow mods - you can post on Freegle Central for advice or just to vent your feelings:

http://groups.yahoo.com/group/FreegleUK-Central

Or on your local mods group – listed here:

http://freegleonestopshop.org/Regional%20Groups/

Or by contacting freegle at: info@iLoveFreegle.org

Making contact with neighbouring group mods can help too. They may have had dealings with the same member.

And finally here is a selection of relevent ADMINS you can use if you need to, or if you have any very serious issues arise, then this is a good one to consider.

Software and other forms of media fall under Copyright agreements.
This message serves to clarify Freegle's stance on the distribution
of computer software, CDs, DVDs and recorded music via AberdeenshireWest Freegle.

Software -- The software being gifted should be:

1. Ideally the original software, not a copy.
2. No longer be used by any previous owner.

Music, Videos, Books and other copyrighted works should be:
1. Original
2. No longer be used by any previous owner.

These are not AberdeenshireWest Freegle policies but regulations pertaining to
copyright.
If you do have software you no longer use, it is uninstalled and you are no longer using it and it meets EULA requirements for transfer, please feel free to post an OFFER or a WANT, making note of system requirements (Operating System, memory requirement, etc) needed to run it.

It is entirely up to the individuals concerned whether they choose to abide by this copyright advisory. YourGroupNameHere Freegle will not be held accountable if you fall foul of Bill Gates and his computer polis :)

or

Please be aware that one of the basic rules is that
items offered or requested *must be legal*. This includes copyright
considerations on items such as computer software, music and films/TV
programmes.

You should not pass on original copyrighted material if you retain a
copy yourself, either on CD (or similar) or digitally. Nor should you
pass on copies of copyrighted material. For computer software, you
should check the terms of your licence agreement, but apart
from "freeware", "shareware" or "open source" material, it is almost
certain that you should remove all traces from your own system before
passing it on. If you hold a valid licence for something but have
lost or damaged the original media, please contact the manufacturer.

It is acceptable to pass on used media as long as you offer them as
such, e.g. CD-ROMs, CDs, video and audio tapes, etc. Offers should
*not* be based on the content of the media.

Please respect this rule, as it would be a serious threat to the
future of re-cycling groups worldwide if they became a forum for copyright
theft. We are aware that a small number of items which contravene
this rule have slipped through in the past, but we do our best to
ensure no items are passed on illegally.

If you are the recipient of an item which you believed would be
original and was being legally offered, but it turns out to be
illegal in some way, please inform the moderators.

Thanks everyone for your understanding and co-operation on this
important issue.
Carolinehttps://wiki.ilovefreegle.org/index.php?title=Copyright_Issues&diff=1369Copyright Issues2010-05-17T13:15:59Z
Caroline:

SOFTWARE, DVDs, VIDEOTAPES AND OTHER MEDIA

Software and other forms of media fall under Copyright agreements -this is the score if you're worried.

Software -- The software being exchanged is in breach of copyright if:
* It isn't the original software.
* It is still being used by any previous owner (although i don't know how you would know this as a Freegle moderator).
* It's been used to get an upgrade.
* It doesn't follow the terms in its End User License Agreement (EULA) - If the EULA makes no mention about transfers or exchanges, treat the software like you would any other work protected by copyright (like a book, CD, or video).

In order to be in keeping with copyright agreements, Music, Videos, Books and other copyrighted works should be:
* Originals, not a copies
* No longer be used by any previous owner.
Often moderators refer messages for tickets and vouchers to café groups because they don’t keep anything out of landfill and, if they are ‘money off’ vouchers, they encourage consumerism and are not actually free.

In Yahoo groups you can choose to have an 'open' or a 'closed' Membership. With an open membership people can just join your group by choosing their message delivery settings and the email address they want to use and then entering a code. With a closed memberhip they do this and then there is a box where they leave a comment to the group owner (this can in fact be viewed by any one with mod privs on the group). Membership is then Pending at which point it can either be approved, denied or if left it will time out after two weeks and yahoo will delete it.

It seems that Freegle Groups, broadly speaking, take three different approaches:

*Those groups that don't approve members and have an open membership list.
*Those groups that do have pre-approval but just approve automatically on application
*And those that send out a letter that the pending member needs to respond to before being approved

To pre-approve or not to pre-approve
Pros of approving members:
* Pending members can be redirected to a closer group to where they live and/or work.

* Mods can get pending members agreement upfront that they will disclose if they intend to sell items on.

* Mods can find out where people heard about the group and use this as a target for publicity.

* It is possible to see how many potential members haven't realised that they have created a Yahoo email address, but there is little that mods can do about this. (This is also listed in the cons)

* Using this method might stop spammers from joining the group.

Cons of approving members:
* It makes more work for the moderators.

* Members often don't reply to the joining email, so groups are losing a vast amount of potential members.

* The more complex the joining process is, the more potential members will be put off joining.

* People might not like being asked questions.

* It is possible to see how many potential members haven't realised that they have created a Yahoo email address, but there is little that mods can do about this. (This is also listed in the pros)

* Spammers might join anyway, so mods could be just wasting their precious time.

Pros of not approving members:
* This saves moderators time.

* Gives moderators more time to spend promoting the group.

* More potential members will join because the joining process is much easier.

* Members don't have to reply to a joining email, which means they won't be lost somewhere in the joining process.

Cons of not approving members:
* It is difficult to find out where potential members have heard about the group, which makes it harder to advertise in the right places.

* Spammers can join undeterred and harvest email addresses.

* It is difficult to redirect people to their nearest group if we don't know their postcode.

How to Pre-approve
Switching on Pre-approval is pretty straight forward, and this is a feature you can deactivate if you change your mind. Some mod groups have been known to temporarily enable this feature if there is a particularly virulent bunch of spammers around.

To Change this setting click management, this can be found on the home page near the bottom of the left hand column (by the way, if your not a moderator on a group, management won't be there). This will take you to a new page, look for the section called 'group settings' on the right and click on 'membership.'

Now you need to click on (edit) next to 'Membership Type and Welcome Message'

Now you have three options:

open -this is the default setting for yahoo! groups it means any one can join your group and they don't need to be approved first.
restricted -you approve all requests, so if you want to pre-approve members this is the box to check.
and closed -only invited members can join. t
Please ignore the third option 'closed' for reasons why and other things you shouldn't do visit this page.

Here is an example of a Joining Letter you can send out to pending members if you like. To do this you need to set up an auto send file.
Carolinehttps://wiki.ilovefreegle.org/index.php?title=To_do_list&diff=1343To do list2010-05-14T22:34:35Z
Caroline: /* the Moderator Handbook */

* Gives moderators more time to spend promoting the group.

* More potential members will join because the joining process is much easier.

* Members don't have to reply to a joining email, which means they won't be lost somewhere in the joining process.

Cons of not approving members:
* It is difficult to find out where potential members have heard about the group, which makes it harder to advertise in the right places.

* Spammers can join undeterred and harvest email addresses.

* It is difficult to redirect people to their nearest group if we don't know their postcode.

* There are always two sides to every story, and some members who appear to be difficult are actually just confused.

Dear [Ex Member]

Thank you for your email in which you say you are considering taking legal
action regarding our local Freegle group.

While I appreciate your concerns, I am not as a local volunteer prepared to
respond on legal issues as it could incriminate me. I advise that you
contact the administration team of this non profit organisation at
info@ilovefreegle.org where someone with the appropriate knowledge and
experience can deal with the matter.

I now will end all communication with you at this time and I have removed
your membership to eliminate further potential risk, harm or
misunderstanding between ourselves. I take your concerns very seriously and
I am sorry that I am not able to act directly in this matter and wish you
well.

Dear Member

The moderators of this group have evidence that you are obtaining items
from group members and are reselling them. Whilst there are no rules
saying that you can't resell items, you must tell the person you got the
item(s) from, of your intention to do so.

If you are found to be selling items and you haven't informed the
member, you are at risk of prosecution by the Police for offences under
the Fraud Act 2006.

The group moderators will co-operate with requests for information from
the Police in connection with any offences you may have committed. This
information could include, but isn't limited to, Group Management logs,
Message Archives and emails.

Please also note that if you are unemployed and reselling items obtained
through Freegle for profit, without informing the DWP, you could
potentially be prosecuted for benefit fraud. HM Revenue & Customs can
also prosecute for tax evasion, if you fail to pay tax resulting from
earnings gained from the sale of any items.

Please consider this email your first warning. If these activities
continue, the moderators will remove you from the group and your details
may subsequently be passed on to the relevant authorities. Any official
request to disclose a member's details will be complied with.

--

Dear $memberid,
Can I check whether you are planning to sell on or make a profit from this item?

We don't mind resellers on the group, but we do ask that they make it known so that members may make an informed decision whether or not to pass on items they may have.

Kind Regards
Dear Member

The moderators of *your group name here* have evidence that you are obtaining items from group members and are reselling them.

Whilst there are no rules saying that you can't resell items, you must tell the person you got the item(s) from, of your intention to do so.

If you are found to be selling items and you haven't informed the member, you are at risk of prosecution by the Police for obtaining goods by deception.

The group moderators are duty-bound to co-operate with requests for information from the Police, Inland Revenue, DWP and/or other Government officials.

This information could include, but isn't limited to, Group Management logs, Message Archives and emails.

Any relevant information can and will be, used as evidence. For example, to support a case of Benefit fraud, brought by the DWP.

So if you are unemployed and selling items for profit, you can be prosecuted for Benefit fraud. The Inland Revenue can also prosecute for Tax fraud, if you haven't paid tax on earnings gained from any items.

Please consider this email your first warning. The moderators will not hesitate to remove you from the group and pass your details on to the relevant people, should a second warning be necessary.
