The Medicines Act (1968) governs the manufacture and supply of medicine for human consumption. There are three categories: &lt;br /&gt;

In order to protect the public’s health, the sale or supply of any medicinal product in the UK is strictly regulated under the Human Medicines Regulations 2012.&lt;br /&gt;
&lt;br /&gt;
To summarise; &lt;br /&gt;
&lt;br /&gt;
- The sale or supply of a prescription only medicine (POM) other than by a registered pharmacist on receipt of a prescription issued by a qualified heath practitioner, is a criminal offence&lt;br /&gt;
 &lt;br /&gt;
- The sale or supply of a pharmacy only medicine (P) other than by a registered pharmacist, is a criminal offence.&lt;br /&gt;
&lt;br /&gt;
- The sale or supply of general sales ledger (GSL) ledger medicine (the sort you would normally find on sale in a non-pharmacy retail outlet) other than from a lockable premises, is in the MHRA’s view, a criminal offence.&lt;br /&gt;
&lt;br /&gt;
The supply of any medicinal product outside the regulated supply chain, poses a serious risk to the public’s health.&lt;br /&gt;
&lt;br /&gt;
Medicines of any kind should not be supplied to the public, other than in the circumstances I have described above.&lt;br /&gt;
&lt;br /&gt;
The MHRA will seek to prosecute those who sell medicinal products outside the regulated supply chain.&lt;br /&gt;
&lt;br /&gt;

Freegle groups don&#039;t supply anyone with anything other than the ability to post a message; like eBay, items are never in our physical possession - they pass directly from one member to another.   No money is exchanged, there is no selling involved, it is purely an act of kindness from one member of a community to another, which also has the added bonus of keeping usable items out of landfill.  Each group is locally run by volunteers.&lt;br /&gt;

We have had a look at eBay&#039;s rules on medicines at http://sellercentre.ebay.co.uk/medicine-and-healthcare-products-policy and would like to know if Freegle groups had a set of rules equivalent to those, would that be legal?&lt;br /&gt;
&lt;br /&gt;
We are aware of the facility for local pharmacies to take in unwanted medicines and then dispose of them, but we are keen to encourage waste prevention in the community.  The government policy https://www.gov.uk/government/publications/waste-prevention-programme-for-england has recently been introduced.  It is a framework for all organisations to rethink their policy, guidelines and actions so that less stuff enters the waste stream.  If it is illegal at present for a private individual to pass on an unwanted GSL item to someone else, then we hope the MHRA will take active steps to set up a safe and legal system for medications (or the packaging) to be recycled or reused instead of being disposed of as waste, or to give people no other choice than to throw them in the bin to end up in landfill.&lt;br /&gt;

UPDATE JUNE 2015:  EU Directive 2011/62/EU amending Directive 2001/83/EC has now put a stop to any medicines being donated, as it has been implemented to ensure there is no break in the licensed audit trial from manufacturer to end user. &lt;br /&gt;

The charity InterCare has therefore had to stop taking unused/returned medicines to send to clinics in Africa. http://www.intercare.org.uk/ but they are still hoping to distribute medical dressings, devices, clothing etc.&lt;br /&gt;

POM-V – these are prescription only medicines and may only be supplied by a veterinary surgeon or pharmacist in accordance with a prescription from a veterinary surgeon.&lt;br /&gt;
&lt;br /&gt;
POM-VPS – these are prescription only medicines and may only be supplied by a veterinary surgeon, pharmacist or suitably qualified person (SQP) in accordance with a prescription from one of these persons.&lt;br /&gt;
&lt;br /&gt;
NFA-VPS – these are medicines that may only be supplied by a veterinary surgeon, pharmacist of SQP&lt;br /&gt;
&lt;br /&gt;
Medicines carrying any of the above distribution categories cannot be offered via Freegle.&lt;br /&gt;
&lt;br /&gt;
There is another distribution category called AVM-GSL.  There are no legal restrictions in the Veterinary Medicines Regulations for the retail supply of veterinary medicines classified as AVM-GSL (“over the counter” medicine) but a responsible approach to the supply of these medicines is still expected.  Medicines carrying this distribution category could be offered via Freegle.&lt;br /&gt;

&#039;&#039;&#039;CCA (chromated copper arsenate)&#039;&#039;&#039;&lt;br /&gt;

A particular issue that does cause concern is that some treated timber contains CCA (chromated copper arsenate) and should not be burnt as firewood. CCA is a wood preservative that has been used for timber treatment since the mid 1930s, but stopped in 2006.  As the name suggests it is a mixture of chromium, copper and arsenic, it imparts a greenish tint to the timber. It is highly effective as wood preservative, often used as a substitute for creosote. It protects against fungal decay, wood eating insects and affords a good degree of weather-resistance. But when burnt, toxic arsenic is released into the atmosphere and the ash from burnt CCA treated timber can contain up to 10 per cent (by weight) arsenic, chromium and copper. Swallowing only a few grams of this ash can be harmful. Symptoms can include nausea and/or vomiting, diarrhoea, and pins and needles feeling in the skin. Common advice is to never burn CCA treated timber as firewood in fireplaces, barbecues, wood stoves or any wood fire.&lt;br /&gt;
&lt;br /&gt;
Any wood designed for indoors use, or which was first used outdoors before 1933 or after 2006 is likely to be safe to burn. CCA was latterly primarily used in fences, sheds, and decks. It was banned initially voluntary, and restricted its use to external use, but later became encoded in law, and it was no longer available at all.&lt;br /&gt;

&#039;&#039;&#039;MB Methyl Bromide&#039;&#039;&#039;&lt;br /&gt;

These pallets have been treated with a highly toxic pesticide which can be necessary in certain regions of the world where there are pests that can’t be eliminated by heat treatments. You should never use MB stamped pallets for a craft project and you should never burn these pallets on a fire. Methyl bromide treatment was made illegal in the UK in 2010 and is being phased out worldwide. Pallets are durable though, so there are some MB stamped pallets still in circulation. So it’s always worth being careful and double checking your pallet stamps. If you can’t tell what the stamp was, don’t use the pallet!&lt;br /&gt;

&lt;br /&gt;
For safety, it is probably best to take a stance that any pressure treated wood is likely to have chemicals that, once burnt, are harmful to health and the environment.&lt;br /&gt;

&#039;&#039;&#039;CHEP Pallets&#039;&#039;&#039; are the blue pallets you might see or occasionally get requests of offers in your community. Regrettably, occasionally online scammers target Freegle groups, often by offering high-value items, and then asking you to pay for courier charges. We catch a lot of these, and you never see them, but sometimes they sneak through.&lt;br /&gt;
&lt;br /&gt;
While some groups allow postage, you should never hand over money in advance. We don&#039;t recommend any specific courier (so if you see a message saying we do, it’s a scam).&lt;br /&gt;
&lt;br /&gt;
If you are unlucky enough to be scammed, please report it to the Police, and to us.&lt;br /&gt;
&lt;br /&gt;
====Privacy====&lt;br /&gt;
We won’t pass on your email address to anyone else, and other freeglers can&#039;t see it.&lt;br /&gt;
&lt;br /&gt;
Other freeglers can see your name. If you don&#039;t want that, you can change it in Settings.&lt;br /&gt;
&lt;br /&gt;
We try to protect you from spammers and fraudsters. Sometimes our volunteers may read what you write to check that it&#039;s not spam, phishing or fraud. If we happen to find something which is against Freegle rules, we may take further action.&lt;br /&gt;
&lt;br /&gt;
If you put phone numbers, email addresses or postal addresses into your posts on Freegle, other people will be able to see them. If you&#039;re concerned about this, don&#039;t do it!&lt;br /&gt;
&lt;br /&gt;
So that potential new users can see what is being offering on Freegle, we make some details of posts public, i.e. the item name, approximate location, the description and any photos. No personal details are made public - unless in this information.&lt;br /&gt;
&lt;br /&gt;
=====Cookies=====&lt;br /&gt;
You&#039;ll have seen lots of irritating popups on websites about consent for cookies. We don&#039;t have one of those because we don&#039;t store any data for logged out visitors which would require that consent.&lt;br /&gt;
&lt;br /&gt;
Here are some technical details on what happens when you&#039;re logged out.&lt;br /&gt;
*We store a session cookie. That&#039;s strictly necessary for the site to function, and does not require consent.&lt;br /&gt;
*We store some information in your browser&#039;s local storage, because of the way the site works. There&#039;s not much in it except if you&#039;re trying to reply to a post. That&#039;s like the &amp;quot;shopping cart&amp;quot; example in the Information Commissioner&#039;s advice and does not require consent.&lt;br /&gt;
*We use Google Analytics to collect traffic statistics. This is configured in a way that means it does not require consent We have a data processing agreement with Google, we have enabled IP anonymization/masking, disabled data sharing, and are not using any other google services in combination with Google Analytics.&lt;br /&gt;
*We use Google and Facebook&#039;s code to allow you to log in. They store a few third-party cookies, of their own, but before you&#039;ve logged in they don&#039;t know who you are. If you are concerned about these, you can install a privacy blocker such as Ghostery and still use the site (but it helps if you donate).&lt;br /&gt;
&lt;br /&gt;
Once you log in, you&#039;re giving us consent to do the following.&lt;br /&gt;
*We store more information in your local storage. Part of this is so that you don&#039;t need to log in as often, and the rest is to speed up the site (it&#039;s a cache).&lt;br /&gt;
*We show jobs ads from WhatJobs, both on the site and in emails. We&#039;d prefer not to, but we don&#039;t raise enough from donations alone to keep going. We don&#039;t pass them any information at all unless you click on one of the job links, not even your IP address.&lt;br /&gt;

* Spend time on the phone with a new mod, both of you looking at pending messages and talk through what to do with the messages. This could also be done by visiting your new mod at home, or meeting up somewhere public with a laptop and wi-fi. This can give more advice, discussion and instant feedback than a training group&lt;br /&gt;
* Consider communicating with each other via instant messaging, such as with Yahoo, Gmail or Skype to talk through pending messages. This can be useful as the mod can look back at the message archive if they forget something&lt;br /&gt;
* Try to have an established mod available for contact by email or phone/text or IM &lt;br /&gt;
* Make contact with the new mod at least once a day until they find their feet&lt;br /&gt;
&lt;br /&gt;
=Try to ensure clarity and consistency for mods= &lt;br /&gt;
&lt;br /&gt;
* Figure out what your policies are* and make sure any new mods know what they are (it&#039;s also helpful to include them in your members handbook so all members and mods can refer to this) *ie: phone numbers, pets, xposting etc (link to advice doc)&lt;br /&gt;
* Help group consistency by providing them with template rejection emails&lt;br /&gt;

* Which posts need to be be referred to the Chitchat group&lt;br /&gt;
* Ensuring that the mod is aware to refer non-local members to their nearest group where necessary to try on their most local group(s) at least 24 hours before trying this one. Explain that this practice is to show support to neighbouring groups, especially ones trying to establish themselves. This establishes expectations of a non-territorial/competitive attitude and strengthens relationships between groups&lt;br /&gt;
*Ensure the volunteer is aware of the document [Our Aims] and that they will be required to agree to it when first joining Modtools&lt;br /&gt;

Once confidence is gained the training group can be used for asking questions. This can also be done through the moderators group. The new mod can say when they feel confident enough to move to the “real” group. A training group can also be used to train a new mod in using the other functions of Modtools, home page editing and so-on. &lt;br /&gt;
*Give link to the Freegle Wiki - but reassure them that they don&#039;t have to read it all at once! &lt;br /&gt;
*invite to join regional mods group and central - perhaps not immediately, but once the mod has had some initial training and is still enthused. This reduces the sense of being overwhelmed and also helps to reduce the numbers of inactive members in these groups &lt;br /&gt;
*In some areas several groups train moderators together, perhaps with one mod training all new ones. &lt;br /&gt;

*We are always respectful to members – if we receive inflammatory replies we cool off and talk to fellow mods before responding&lt;br /&gt;
